These Terms and Conditions, and Privacy Policy referenced herein, dictate the terms on which you, a User, may make use of our Web Site and Phone Line, and govern the relationship between you and Wahy Limited (trading as Wahy London). Please read this page carefully before you begin to use the Web Site or Phone Line. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Web Site or Phone Line. If you do not agree to be bound by these Terms and Conditions, please refrain from using our Web Site or Phone Line.

1. Definitions and Interpretation

In these Terms and Conditions, the following terms shall have the following meanings:

“Account” means collectively the personal information, Payment Information and credentials used by Users to access Content and purchase Goods through the Web Site.

“Acknowledgement Email” means an automated e-mail sent from Wahy Limited (trading as Wahy London)  to confirm that we have received an order;

“Carrier” means any third party responsible for transporting purchased Goods from our storage facilities to the delivery address provided.

“Content” means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site.

“Despatch” means the time at which we take payment for any Goods that a User has ordered or the time at which we dispatch the Goods that a User has ordered to the delivery address provided, whichever is the earlier.

“Goods” means any product or products that Wahy Limited (trading as Wahy London) advertises or makes available for sale through this Web Site.

“Payment Information” means any details required for the purchase of Goods from this Web Site. This includes, but is not limited to, credit and debit card numbers, bank account numbers and sort codes.

“Purchase Information” means collectively any orders, invoices, dispatch notes, receipts or similar information that may be in hard copy or electronic form.

“Returns Address” means, Wahy Limited (trading as Wahy London), 103 Railway Arches, Cannon Street Road, London, E1 2LY, United Kingdom.

 

“Service” means collectively any online or telephone facilities, tools, services or information that Wahy Limited (trading as Wahy London) makes available through the Web Site or Phone Line either now or in the future.

“System” means any online or telephone communications infrastructure that is made available through the Web Site or Phone Line either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links.

2. Age and Legal Restrictions

Persons under the age of 18 should use our Web Site and Phone Line only with the supervision of an Adult. By placing an order you warrant that you are legally permitted to enter into binding contracts and that you are at least 18 years old.

3. Orders

3.1 On placing an order via the Web Site, you will receive an Acknowledgement Email. This does not mean that your order has been accepted. Wahy London (trading as Wahy London) reserves the right to refuse orders from any User.

3.2 Your order constitutes a contractual offer by you to us to buy Goods. Your contractual offer is deemed to be accepted by us only upon the Despatch of those Goods. We will not be obliged to supply any other Goods which may have been part of your order for which Despatch has not occurred. Wahy Limited (trading as Wahy London) reserves the right to cancel orders without stating reasons, for any reason prior to Despatch. If payment has not been taken at Despatch, then we will include a copy of the despatch invoice with the Goods.

4. Availability, Risk & Pricing

4.1 Stock indications are provided on the Web Site however these may not take into account items purchased in around the time of your purchase and can be subject to error. Hence all Goods on the Web Site are subject to availability and may be withdrawn at any time prior to Despatch.

4.2 Gift Hamper contents are subject to substitution should a component product be unavailable at the time in which the goods are prepared for despatch. An item will be substituted for the most similar product of similar or higher value. If such an item is unavailable, we will contact you to discuss the order in further detail. Dietary requirements should be specified on your order notes at the time the order is placed.

4.3 Goods will be at the User’s risk from the time that they have been received at the delivery address provided. Ownership of Goods will only transfer to the User when full payment of all sums due in respect of the Goods has been received.

4.4 The price of all Goods purchased via our Web Site, subject to Clause 4.6 below, will be as quoted on the Checkout Page of the Web Site from time to time, except in the cases of obvious error, including but not limited to clerical and typographical errors. These prices include VAT (if applicable) but exclude delivery costs. Delivery costs shall be as quoted on our Web Site from time to time, except in the cases of obvious error, including but not limited to clerical and typographical errors.

4.5 For purchases from outside the UK, import duties and taxes or equivalent may be due and payable in the jurisdiction in which the Goods are ordered and/or delivered. You will be responsible for the payment of all these charges.  Wahy Limited (trading as Wahy London) assumes no responsibility for these charges and we undertake to make no calculations or estimates in this regard. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. As the buyer of the Goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Goods may be inspected on arrival at port for customs purposes and Wahy Limited (trading as Wahy London) cannot guarantee that the packaging of your Goods will be free of signs of tampering.

4.6 Prices are liable to change at any time because of variations in raw material prices for example. These changes will not affect orders for any Goods for which Despatch has already occurred. However, in the event that the prices or delivery costs of any Goods ordered change after the order for those Goods is placed but prior to the Despatch of those Goods, we will contact you using the contact details you provide us to check whether you still want to proceed with the order on the basis of the new prices and delivery charges.

4.7 You can pay for any Goods ordered via the Web Site in full by VISA credit or debit card, Mastercard credit or debit card, and American Express credit card.

4.8 These prices include VAT, if applicable, but exclude delivery costs, which will be included in the total amount due

If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

In the event that import duties and taxes remain unpaid by you, we are under no obligation to compensate for any losses as a result of destruction or abandonment of your order.

5. Delivery

5.1 Wahy Limited (trading as Wahy London) delivers Goods worldwide except to PO Box addresses.

5.2 We will endeavour to deliver Goods within 30 working days from the date on which the order for those Goods was placed, expect for circumstances beyond our reasonable control. If we are unable to deliver your order within 30 working days, we will notify you in writing of the delay. In the event of a delay in delivery of greater than 30 working days you may cancel your order resulting in us providing you with a full refund.

5.3 We will notify you by email to confirm Despatch of Goods. This email will contain details on the estimated delivery time as well as any tracking information were provided by the Carrier.

6. Returns, Refunds and Replacements

1.     Wahy Limited (trading as Wahy London) offers a 14 day return policy on all items, for any reason, excluding those items that are personalised or customised to specific requirements.

2.     Please note that the delivery charge for the original order will not be reimbursed, and we are unable to reimburse your postage costs for returning items to us, and the risk remains with you until we receive the items.

3.     Unwanted items can only be returned provided that all packaging remains unopened, any seals remain unbroken and that the items are returned in their original condition to us.

4.     To return unwanted item(s), please send an email within 14 days of the date on which the goods were delivered to support@wahylondon.com with the following details:
4.1 Your order number
4.2 The item(s) in the order that you wish to return
4.3 Reasons for wanting to return the item(s)
4.4 Whether you are returning the item(s) in the post or to our London store, 103 railway Arches, Cannon Street Road, London, E1 2LY, United Kingdom.

5.     Please do make sure to pack the unwanted item(s) carefully to avoid any damage in transit.

6.     Once we have received and reviewed the returned item(s), we will process your refund within 5 working days of receipt.

Returning damaged, incorrect or defective items for a refund or replacement

1.     Wahy Limited (trading as Wahy London) free returns on all items that are damaged in transit, incorrect or defective.

2.     If you find that any items in your order are damaged in transit, you should sign the delivery note, where possible, to the effect that the items have been damaged and send us an email at support@wahylondon.com within 14 days of delivery of the order.

3.     If you find that any items in your order are incorrect or defective, including any items that have been personalised, then you should send us an email at support@wahylondon.com within 14 days of delivery of the order.

4.     Please provide us with the following details in your email:
4.1 Your order number
4.2 The item(s) in the order that you wish to return
4.3 What is wrong with the item(s)

4.4 Photos of the item(s)
4.5 Whether you would like for us to replace the item(s) or refund the item(s)
4.6 Whether you want to return the item(s) in the post or to our London store, 103 Railway Arches, Cannon Street Road, London E1 2LY, United Kingdom

5.     On receipt of your email, we will issue you a RMA number and send to you via email:
5.1 a return label if you choose to return the item(s) in the post; or
5.2 details for returning the item(s) in-store if you choose to return the item(s) at our London store.

6.     If you choose to return the item(s) in the post, you will need to print out the return label, attach this to the outside of your package and drop this package off at your nearest Post Office.

7.     Please do make sure to pack the unwanted item(s) carefully to avoid any damage in transit.

8.     If you requested a refund, we will review and process your refund within 5 working days of receipt of the returned items. If all items in your original order are returned, the delivery charge for that order will be refunded. If not all the items in your original order are returned, the delivery charge for that order will not be refundable

9.     If you requested a replacement, we will despatch this within 5 working days of receipt of the returned items. You will not be charged any additional costs for delivery of replacements.

7. Intellectual Property

7.1 Subject to the exceptions in Clause 9 of these Terms and Conditions, all Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Wahy Limited (trading as Wahy London) or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and international intellectual property and other laws.

7.2 Subject to Clause 7.3 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by Wahy Limited (trading as Wahy London).

7.3 Notwithstanding Clause 7.2, material from the Web Site may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

9.1.2 You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist.

Please be aware that purchases can only be cancelled before Despatch. In the event that Despatch has occurred for an unauthorised purchase prior to your notifying us of the unauthorised nature of the purchase, Wahy Limited (trading as Wahy London) accepts no liability or responsibility and you should make direct contact with the Carrier detailed in the Purchase Information.

10.4 Either Wahy Limited (trading as Wahy London) or you may terminate your Account. If The Wahy Limited (trading as Wahy London) terminates your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, we reserve the right to terminate without giving reasons.

13.2.2 for fraud or fraudulent misrepresentation.

14. Changes to the Phone Line, Web Site and Terms and Conditions

14.1 Wahy Limited (trading as Wahy London) reserves the right to change the Phone Line, Web Site, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the Web Site following the changes. 17.2 Subject to clause 13.2, Wahy Limited (trading as Wahy London) will have no liability to you under these Terms and Conditions if we are prevented from, or delayed in, performing our obligations under these terms by anything outside of our reasonable control.

17.3 In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

17.4 These Terms and Conditions, and the Privacy Policy referenced herein, represent the entire agreement between you and Wahy Limited (trading as Wahy London), in relation to the subject matter contained herein.

17.5 In the event that any of these provisions are found by any court or administrative body of competent jurisdiction to be unlawful, invalid or otherwise unenforceable, that Clause is to be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions. This severance shall apply only within jurisdictions where the provision is found illegal.

17.6 These Terms and Conditions and the relationship between you and Wahy Limited (trading as Wahy London) shall be governed by and construed in accordance with the laws of England and Wales and Wahy Limited (trading as Wahy London) and you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
